A Power of Attorney is a legal document that allows your attorney (the person appointed by you) to manage your legal (including real estate) and financial affairs on your behalf. This is particularly useful if you become incapacitated due to any physical or mental health problems, or in the event of your absence. We can prepare a Power of Attorney for a real estate transaction and restrict it only for that transaction and register it with the Land Title Office.
Wills are a critical tool for outlining wishes for the distribution of assets, guardianship of minor children, and the designation of an executor who takes care of administering the estate. By not having a will, you lose control over who gets how much of your estate. You also give up the right to appoint a guardian of your choice for any young children you have. We will assist you through the process of ensuring your loved ones know your wishes. We also file a Wills Notice with Vital Statistics once executed.
A representation agreement is a tool that allows your appointed representative to make personal and health care decisions for you. If you become incapacitated, there are 2 types of Representation Agreements, Standard (section 7) and Enhanced (section 9). Standard Representation Agreements cover routine financial and/or health care decisions, while enhanced Representation Agreements give broader powers to the representative, including refusing health care necessary to preserve life (life support).
